Satire and Social Criticism

The Enlightenment is a period in history that was characterized by diversity of advances in philosophy, science and medicine. The main theme of the enlightenment was the belief that people of the world could actually make an effort to create a better world. In the process, the philosophers embraced different figurative tools to enlighten the people, and among these, satire stood out. Satire especially assumed the form of bitter, harsh criticism to hypocrisies, injustices and inhumane practices that characterized the society at the time. Candide by French philosopher Voltaire is a bizarrely humorous tale chronicling the adventures of a young man throughout the world, but the aspect that has made it generate so much interest is how it satirically challenges the social norms and optimism that characterized the age. First, Voltaire pokes fun at the noble family by naming the barony Thunder-ten-tronckh, a silly set of words aimed at attacking the pride the baron’s family have in their noble heritage. Voltaire is challenging natural superiority assumed by aristocrats. For example, the baron’s sister, despite being the mother of Candide, refused to marry his father merely because he had 71 noble lineages while she had 72 (Voltaire, 2008). The satire here manages to make the concern nobles had over â€Å"lesser people† look primitively absurd. Dr. Panglos (the name translates to â€Å"all-tongue†) belonged to the â€Å"metaphysico-theologo-cosmolo-nigology† school of thought. He often taught the young Candide the principles of his doctrine which upheld the belief that all things were created with a purpose, which is ultimately the best purpose (Voltaire, 2008). Voltaire uses Pangloss to parody the philosophers of the 17th century and before who debated topics of no benefit to humanity. Voltaire most likely felt that the verbal acrobatics of these thinkers were so ridiculous and critics of this tale feel that he was lampooning the philosophies of Leibniz. Leibniz believed that a pre-meditated harmony existed in the world and that the world must be the best place ever since a perfect God had created it. Voltaire, on the other hand, is an opponent of this blind optimism on account of the tragedies that afflict mankind. He uses the difficulties Candide has to endure and the Lisbon earthquake which claimed over 75 percent of the city despite a ritual which involved burning some people in a slow fire in order to prevent catastrophes like these having been conducted. The tragedies that Candide suffers in the hands of the Bulgarian army underline the cruelty and suffering that existed within armies. Noblemen started war, and it was the common men serving in the battlefields that bore the full brunt of conflicts (Voltaire, 2008). While the people are suffering, clergymen hypocritically squabble over religious doctrines and worry more about converting people into their faith instead of tackling the wars, famines and oppression which plague the society. Many satirists have developed a sense of satire that is more or less in line with the stances Voltaire adopted in his effort to reform the society. I choose to analyze the Daily Show hosted by Jon Stewart since 1999. Jon Stewart applies satire to address the social, political, and economical issues facing the American society in the present time. Among his themes are political tolerance and the extent to which current events affect the youth not only in America but also in the whole world (The Daily Show, 2007). The Daily Show has aired every Monday to Thursday since July 1996 on Comedy Central and hosts a variety of political and celebrity figures with the aim of getting their opinion on current socio-political issues affecting the American society. Watching an episode of the Daily Show, I visualized Jon Stewart wanting his audience to approach current issues with pragmatism. I watched the episode in which he hosted 2008 republican presidential candidate John McCain. McCain, as part of his presidential campaigns, had announced that he would make an appearance at Liberty institution, an institution founded by Jerry Falwell who McCain had earlier denounced as an agent of intolerance (The Daily Show, 2007). Stewart rightfully identified the hypocrisy of the appearance knowing that it was in direct opposition of the principles McCain so often preached. It was an attempt to just secure votes against the values the candidate had preached all along. Jon Stewart’s show assumes that that any political leader should stand his ground and stick to his or her beliefs with regard to the issues that affect the society (The Daily Show, 2007), failure to which he or she would be drifting into â€Å"madness†. Desperate attempts to win over public support in policy issues should be based on conviction rather than on hysteria as stirred by those seeking political office. Stewart wanted the society to see people for what they really were, as a strategy to establishing a just system, rather than the instantaneous stances they adopt when the need arises.

Marc Jacobs Brand Analysis Essay

There has been much debate within the fashion industry about what kind of branding strategy to pursue. With the increasing democratization of fashion ushered in by globalization fashion designers have been able to create and/or transform their labels to have a strong and strategic world-wide presence. The two main schools of thought within branding strategies are globalization and adaptation. Thus a fashion company must traverse the terrain and select which strategy suits the company’s policies, aims and mission. Theodore Levitt launched the globalization debate in 1983 with his seminal essay in the Harvard Business Review ‘The Globalization of Markets† arguing that communication, transportation and travel created a new commercial reality where corporations did not cater to local differences in taste. He believed that the world, its various cultures and borders, were uniting, which resulted in the dissolution of multinational corporations, and the rise and domination of global corporations (Levitt, 1983). There have been many supporters toward this faction of thinking which include Elinder (1965), Fatt (1967), Buzzell (1968) and Dunne (1976) whom feel, as with Levitt that the globalization of markets has come about because of advances in transportation, and most importantly technology. This strategy believes that one marketing campaign can be used and translated to its customers world-wide, and is adequate for their purposes. Standardization also assumes that their target customer is completely homogenous and should be pursued in the same manner. The adaptation strategy and its supporters on the other hand, believe that the market and its customers are heterogeneous. The followers of adaption namely Anholt (2000), Kanso and Nelson (2002) and Kotler (1986), argue that marketers and branding professionals need to consider difference in economics, cultures, competition, technology, sociology, physicality, politics, infrastructure; as well as the level of customer similarity (Vrontis, 2003). This strategy is clearly opposite to that of standardization. What the managers of companies need to decide early on is, which strategy they will adopt acknowledging that both factions has positive and negative points. Another approach that is widely exploited is that of a  hybrid, adopting certain aspects of each strategy to obtain the greatest advantage whilst negating the negatives. This strategy is promoted by many since the late nineteen eighties namely Vrontis and Vronti, (2004), Kotler et al., (1996), as well as Douglas and Wind (198 7), With an abundance of strategies to choose from and the swift pace of the global fashion industry, which is becoming more competitive every day, it is of utmost importance to have a clear message and brand identity to launch to the fashion world. Using Marc Jacobs as a case study, this paper will investigate his labels approach to marketing and branding within the United Kingdom and the United States to demonstrate how Marc Jacobs uses standardization. This approach is illuminated through his product ranges, advertising, shop decoration, and marketing, which have been inherent since the beginning of the branding process. To keep up in today’s ever changing industry, fashion labels like Marc Jacobs, need to be highly differiented, customer-oriented, constantly innovative and create effective powerful brands (Aaker and Joachimsthaler, 2000). Marc Jacobs has executed what Aaker and Joachimsthaler (2000) set out with sheer precision. Since graduating from Parsons School of Design in 1984, where Marc Jacobs won two Golden Thimble Awards, he has had a loyal following both with the media and customers alike who have backed him through his many ventures. His clothes have been described as uptown, downtown – and all around, chic eccentricity, edgy and chic, friendly downtown cool as well as breezy and discreet luxury (Foley, 2004 and Cohen, 2001). Jacobs has an innate perception of how women and men want to dress each season; a sense of the past and how the passage of time changes the definition of beauty and glamour (Shaw, 1993). Having his finger on the zeitgeist each season, year after year, has made his name synonymous with retro-chic cool urbanites and celebrities. On the one hand, Marc Jacobs, the person, his personality, are what his customers are buying into and what is being marketed. On the other, it is his association as head designer for ready-to-wear at Louis Vuitton and how he has transformed that company. This position propelled him to global fashion stardom making him a household name. His characteristics of charming, spirited, cool, arty, high, low and edgy all describe his designs  (Aaker, 1996) and his customers are buying into this personality and identity mix. This blend extends to the way Marc Jacobs dresses himself, and as an extension his clientele. â€Å"I buy very expensive clothes and very inexpensive clothes. People do not dress in designer clothes from head to toe. They may wear a $40 shirt with $600 shoes. That’s the way we’ve always shown the collection (Shaw, 1993).† This is how their younger, arty and celebrity customer dresses. They wear clothes that can traverse the polished sophistication of uptown and the edgy, hip, distressed chic of downtown. â€Å"Brand personality can help by enriching†¦ perceptions of and attributes toward the brand, contributing to a differentiating brand identity, guiding the communication effort and creating brand equity (Aaker, 1996, p.150)†. The brand personality, and its personality traits, are also created by various marketing variables such as user imagery, advertising style, packaging and logo, price, and product-related attributes (Levy 1959, Plummer 1985, Batra, Lehmann, and Singh 1993). All of which are extremely important to the Marc Jacobs branded image and lifestyle that is standardized in both the UK and USA. Though Marc Jacobs brand identity and marketing is driven by his own personality and has been a chosen strategy, there are negative’s to this approach. In this case, the personality is living and has their own life, which changes and acquires a dimension and symbolism, which may not always correspond with the brand’s strategic interests (Kapferer, 1997). For instance, it is commonly known that Marc Jacobs has been battling drug addiction for many years and has had a recent bought in a rehabilitation facility. This episode does not seem to have affected the brand’s image and personality, though it is a caution for adopting this strategy; especially with a personality that is in the public eye and imagination. Jacobs’s success has earned him five designer of the year awards in women’s wear, men’s wear and accessory design by the Council of Fashion Designers of America throughout the last fifteen years. These prestigious awards have assisted in leveraging his brand, which is worth 5 billion dollars according to Fortune magazine (Borden, 2007) and enabled Jacobs to expand the company. What has also assisted Jacobs and his business partner  Robert Duffy’s vision to build the brand architecture, is the stake that Moà «t-Hennessy-Louis-Vuitton (LVMH) owns, which is 96% of Marc Jacobs International L.P. but only 33% of trademarks, meaning that LVMH has power over the money, but Jacobs has creative control.[1] With the backing of LVMH using brand architecture as an organizing structure of the brand portfolio, which gives specific roles and relationships to various products has become a reality (Aaker and Joachimsthaler, 2000). The Marc Jacobs brand portfolio has gro wn immensely since he first started the company with Duffy in 1993. That year saw the launch of his women’s collection and in 1995 the first full men’s collection was introduced. Expanding into the men’s market assisted in leveraging the brand assets, creating a synergy by generating brand exposures and more associations in different contexts (Aaker and Joachimsthaler, 2000 and Kapferer, 1997). These two Marc Jacobs collection lines are the strategic brand as they represent the majority of sales and have become the driver role for other extensions and ranges within the portfolio (Aaker and Joachimsthaler, 2000 and Kapferer, 1997). The women’s and men’s collection have thus expanded to include footwear, bags, eyewear and fragrance creating new line extensions in other product classes which is the ultimate way to leverage the brand (Aaker, 1996). The collection line extensions or sub-brands expands the user base, provides variety for the customer that would like to buy into a total image or lifestyle, energizes the br and as well as manages innovation within the brand (Aaker, 1996). Jacobs’s accessories and his fragrances for both men and women have become his cash cows. The cash cow has a significant customer base and its role is to generate margin resources that can then be invested back into other brands and extensions (Aaker and Joachimsthaler, 2000). Utilizing this strategic approach assists customers who cannot afford the collection but can buy into the brand, starting with a perfume or a handbag in hopes of one day being able to purchase a variety of clothes and other product offerings. Cash cow roles help to build up the brand portfolio as well as create customer loyalty. With the success of his main collection line, Marc Jacobs launched Marc by Marc Jacobs (in 2001), a diffusion or secondary line/brand that made Jacobs more accessible to the very important middle retail market (Moore,  Fernie, and Bert, 2000). The movement into diffusion lines is completely linked to the drive of greater profits, which is linked to public demand. The trouble a brand faces in moving down vertically is risking the brand’s reputation, customer base, quality and credibility especially when coming from a luxury brand (Aaker and Joachimsthaler, 2000, Kapferer, 1997 and Aaker, 1996). Luckily, Jacobs has avoided this successfully without cannibalizing his high-end brand. One explanation of this is that Jacobs’s designs lend themselves to being made in both expensive and moderate priced materials and do not lose their cool. For example, Marc Jacobs produces a thermal jumper in cashmere that sells for 300 pounds and the same design in less luxurious wool sells for 80 pounds in the Marc by Marc Jacobs range (Borden, 2007). Robert Duffy states â€Å"There is a huge difference in feel and quality, but there is a customer base for both (Borden, 2007, p. 3)†. In this case the diffusion line actually enhances the brand’s presence in this very different context not just from increased visibility but also the positive associations generated (Aaker and Joachimsthaler, 2000). The response to this line was so encouraging a men’s Marc by Marc Jacobs line was added along with shoes, bags, eyewear, accessories as well as timepieces for both men and women. In effect the diffusion line and its extensions have been playing the role of the silver bullet brand by positively influencing the image of the strategic brand (Marc Jacobs) (Aaker and Joachimsthaler, 2000). Strategically though the ready-to-wear collection provides the much needed PR but the diffusion lines and their extensions and the collection extensions horizontally drives and creates the revenue (Moore, Fernie and Burt, 2000). The linchpin brand of the Marc Jacobs portfolio and architecture is the accessories line which is housed in its own free-standing store in New York, as well as a multi-branded store in London. This line of accessories is priced even lower than the accessories offered in the Marc by Marc Jacobs lines and is cultivating new customers by the hundreds of thousands. Marc Jacobs staffers like to call this store and line the â€Å"junk store† but the results are anything but. The accessories line and store sells anything from $90 leather bags, to $20 T-shirts to $5 heart shaped make-up compacts as well as flip-flops, gloves, hats, scarves and wellington rain boots. The low  cost of the merchandise is the allure and initiates an even younger customer than the diffusion line into the cult of the brand. The idea of this line is to increase brand recognition and ultimately overall revenue. (Jana, 2006). This line is 70% of units sold in Marc Jacobs stores, which totals around $20 million (Borden, 2007). The accessories line and shop in New York City generates $25,000 per square foot, which exceeds the $4,032, which is earned by the average Apple store the highest in a study by Bernstein Research (Borden, 2007). Gail Zuader a manager of boutique investment bank Elixir Advisors states â€Å"Marc Jacobs has achieved that rare feat of creating a secondary line that doesn’t dilute the value of the high-end with a focus on tongue-in cheek design that allows people to mix it up (Borden, 2007, p. 3)†. This directly relates to Jacob’s comments back in 1993 about his customer wearing expensive and inexpensive clothes, this can now be done with his whole brand architecture. A Jacobs follower can wear a collection dress from the high-end ready-to-wear line and mix it up with shoes and sunglass from the Marc by Marc Jacobs diffusion line. Then accessorize with cheap accessor y handbag and a few bracelets. Again, the Marc Jacobs brand has been extended horizontally with the introduction of the luxury home wares sub-brand in 2003, which includes crystal (produced in Eastern Europe from some of the best known manufacturers), sterling silver, cashmere pillows and other luxuries. This extension is also a silver bullet brand as it both positively influences the strategic brand, and maintains the luxurious cool edge that the label stands for. Marc Jacobs brand architecture has been fuelled by the ever increasing money spent on luxury products throughout the world. According to Verdict research company the luxury retail sector is worth 263 billion dollars for October 2007 and is rapidly accelerating by 71% (Verdict and Thind, 2007). The factors that have contributed to this increase include higher net disposable income among middle to top earners, increased leisure time, as well as economic recovery within several major countries including the United States and the UK (Moore, Fernie, and Bert , 2000). A luxury company would be foolish not to expand in as many areas as possible without overextending its offerings to tap into the money being increasingly spent in this sector. Marc Jacobs success can be contributed to standardized  marketing, brand identity, image as well as product offerings between the US and the UK. The image and the identity of the brand are two different items and are not to be confused. The image deals with perceived notions from the customer’s side whilst the brand identity is the picture the organization wants to send out to the public at large and its customers (Kapferer, 1997). The identity is sent out through the Marc Jacobs logo, advertising, store design and products. The logo is the words Marc Jacobs in a black font that is classic yet retro, not too thin or too thick, a medium thickness that is bold behind the white page. (Fig. 1) This typeface is standardized on all product offerings, line extensions, sub-brands and advertising. The black and white palette is kept throughout. The words may change as well as the offerings but the typeface is always the same. In this sense the font has become an icon of the label like Jacobs himself. To compete in a global market, a global advertising and marketing strategy and product development strategy are integral to the luxury fashion brand. The average money spent on advertising is anywhere between 20-30 per cent of a company’s gross margin higher than it ever has been (Moore, Fernie, and Bert, 2000). â€Å"Every successful fashion brand is based upon an image; the way that you make that image is through your advertising. Fashion thrives on advertising. Advertising is what creates the identity and attraction (Moore, Fernie, and Bert, 2000, p. 932).† The Marc Jacobs advertising campaigns, which are all shot by world renowned photographer Juergen Teller since 1997, is integral to the brands standardized marketing campaign and has greatly contributed the Jacobs image of being arty, cool, hip and of the moment.[2] The images shot by Teller are normally of artists, directors, musicians, and actors in beautiful colours. Normally the product in the photograph is secondary to the poses, actions, background and expressions of the person(s) being photographed. The photograph is always in the middle of a stark white background the product name below it in the iconic Marc Jacobs font. The people that have been included in the advertising such as Sofia Coppola, Charlotte Rampling, Samantha Morton, Kristen MacMenamy, Meg White of the White Strips and Kim Gordon of Sonic Youth have also contributed to the brands identity and image. (See Fig, 2) Bernd Schmitt states: Customers want products, communications and marketing campaigns that dazzle their senses, touch their hearts, and stimulate their minds [as well as] things they can relate to and that they can incorporate into their lifestyles. They want these things to be able to deliver a desirable customer experience (Schmitt, 1999, p.22). Thus he aligns the brand with people who are thought to be â€Å"cool†, â€Å"hip† or â€Å"of the moment† and in turn this has positive associations for the customer base and the brands offerings. These advertisements are seen both in American and UK high fashion magazines. For instance Vogue’s UK December 2007 issue features an advertisement for the Daisy perfume, the same ad is also in the December issue of Vogue in the US as well as Harper’s Bazaar in the US. This standardized marketing strategy is clearly chosen so the image and identity is not diluted between the countries; especially since the ideal Marc Jacobs customer has the income and luxurious lifestyle to fly between the two, and are the main markets for the brand. Though LVMH does not break down sales by brand, instead giving turnover by operating division, Table 1 clearly shows that Europe and the US are the biggest market for the luxury group, Europe generating 35% of group sales whi lst America is the largest single market. LVMH: Group sales, by region, 2005 Source: LVMH/Mintel Though there are Marc Jacobs stores in six cities in America and only one in the UK, London, the product offerings are standardized between the two. This is evident by visiting the stores in both countries and visiting the website where all the products are displayed, along with videos of the runway shows as well as news and gossip, all contributing to the marketing. By choosing to standardize the products amongst the two markets, stores, and on-line Jacobs adopts Levitt’s strategy, â€Å"at a relative low cost – as if the entire world were a single entity; it sells the same thing in the same way everywhere (Levitt, 1983, p.292).† Standardization for the brand increases its profits and visibility in both market sectors. The store’s interior  design and window displays are also uniform. Jacobs and Duffy have enlisted designer Stephen Jaklitsch to design the store’s interiors, completing twenty one stores to date. He designs â€Å"hip but comfortab le environments that mix high-end residential furnishings with sleek finishes and cheeky detailing (Kim, 2004, p. 126).† Jaklitsch’s design for the Marc Jacobs shops represents an evolution of the brand concept and is mostly standardized though each space has its own challenges. â€Å"We do adhere to consistent color and materials palettes. We always use black-stained floors and luxurious materials like marble for the collection stores. I work to create backdrops that are as edgy as the clothing, yet a little more timeless (Kim, 2004, p.127).† Having harmony amongst the retail shops’ designs and the products offered customers in both countries ensures the same aesthetic experience, retail experience and service that the luxury brand is known for. The display windows are another extension of this standardization. During the month of June this year, the shop windows had a Blondie display theme with a large pop orientated portrait of Debbie Harry, with co-coordinating Blondie T-shirts on the mannequins; both in America and the UK. These windows are displayed on the website under featured windows and it is evident that the windows are an important part of the global marketing strategy, as it is presented on the website. The windows are also eye catching and creative, enticing the walker-by on the street, into the store placing special importance on them. The windows for September 2007, featured the newly launched Daisy perfume. Here the art direction allows for some creative flourishes as the mannequins and other decorative displays are specialized for the windows in both countries, though the theme and many elements are uniform. The importance of the window displays shows how the design can be standardized across countries, but equally innovative and exciting for the customer. Using Marc Jacobs as a case study, it is evident that a globalized strategy for products and marketing is still alive and used by global luxury companies as Levitt predicted in 1983. The markets have greatly increased, and drastically changed since this seminal article was written and in our postmodern society many consumers want greater differientation and customization. It will be interesting to see if Marc Jacobs can continue to  survive with a uniform marketing strategy and product offering, or if the brand will have to adapt their strategy for a hybrid one. Historical Roots of Terrorism Colin Gray writes thatterrorism is as old as strategic history.The roots of terrorism can be traced back in time to ancient Greece, andterrorist acts have occurred throughout history since that time. The termterrorism, however, originated in the French Revolutions Reign of Terrorand was popularised at that time.Terrorism in this era carried a very positive connotation as it was undertakenin an effort to establish order during the anarchy that followed uprisings inFrance in 1789. It was considered to be an instrument of governance institutedto intimidate counter-revolutionaries, dissidents and subversives and wasassociated with the ideals of democracy and virtue. In fact, according toHoffman, the revolutionary leader Maximillien Robespierre claimed that virtue,without which terror is evil; terror, without which virtue is helpless andthat [t]error is nothing but justice, prompt, severe and inflexible; it is thereforean emanation of virtue. Terrorism at thestart of the twentieth century retained the revolutionary connotations it hadacquired during the French Revolution as it took aim on the Ottoman andHabsburg Empires. In the 1930s, the meaning of terrorism mutated to describeactivities of totalitarian governments and their leaders against theircitizenry in Nazi Germany, Fascist Italy, and Stalinist Russia. For instance,in Germany and Italy, gangs of brown shirts or black shirts harassed andintimidated opponents, although leaders of these nations denied that thisoccurred. After World War II, the meaning of terrorism changed once again,returning to its revolutionary connotations where it remains today. Terrorist activitiesin the 1940s and 1950s primarily focused on revolts by indigenous nationalistgroups opposing colonial rule in Asia, Africa, and the Middle East, resultingin independence for many countries. Although terrorism retained itsrevolutionary connotation in the 1960s and 1970s, the focus shifted fromanti-coloni alist to separatist goals. Secondly, the goals of terrorism then and now were and are tocreate a new, better society.But, terrorism today has changed in some very fundamental ways: (1) terroristorganisations have evolved into network forms and are less often organised inhierarchies; (2) the identities of transnational terrorist organisations areharder to identify because they claim responsibility for specific acts lessoften; (3) todays terrorist groups do not make demands as often as in the pastand their goals appear to be more hazy and vague; (4) motives have generallyshifted from those that are more politically-oriented to those that are morereligiously-oriented; (5) targets of terrorists are more dispersed around theglobe; and (6) terrorist violence, today, is more indiscriminate, involvingsignificant collateral damage to the public. With thishistorical foundation, particularly the description of the evolution ofterrorism into its current form, the focus now shifts to possible solutions todealing with the issue today. Possible Solutions to Terrorism To effectively meet thechallenges of terrorism, one should consider the history of terrorism, but mustalso look to the future. Kress and colleagues contend that terrorism isincreasing in geographical scope, numerical frequency, and intensity as wellas in ingenuity and subtlety. They suggest that these trends could welltranslate into more varied threats and more powerful tools and weapons, addingthat bombs will get smaller and more powerful, poisons and mind-blowing drugsmore insidious, psychological techniques for converting or brainwashing thevictims more effective, and psychological tortures more agonizing. Ian Lesser offers acomprehensive approach for meeting the challenges of terrorism. His approachconsists of a core strategy and supporting strategies aimed at targetingsecurity threats posed by terrorists within a context of global securitythreats from all sources. Lessers core strategy consists of four components:(1) reducing systemic causes of terrorism, (2) deterring terrorists and theirsponsors, (3) reducing risks associated with superterrorism, and (4)retaliating in instances where deterrence fails. In reducing system causes ofterrorism, Lesser is referring to the long-term goal of addressing issues thatgive rise to terrorism such as social and economic problems, unresolved ethnicand nationalist conflicts, frustrated political ambitions, and personalexperiences of individuals who may become future terrorists. In deterringterrorists and their sponsors, Lesser suggests taking massive and personalactions against terrorist leadership, although he concedes that this is becomingmore an d more difficult as terrorists and their sponsors become more diverseand diffuse. In reducing risks associated with superterrorism, Lesser callsfor eliminating weapons of mass destruction that terrorists could use ininflicting destruction and suffering. And, finally, in retaliating whendeterrence fails, Lesser suggests developing the means to retaliate quickly andspecifically to terrorist activities. One of Lessersstrategies supporting his core strategy is environmental shaping, whichinvolves exposing sponsors of terrorism to global scrutiny and isolation;shrinking the zones of chaos and terrorist sanctuary; includingcounterterrorism as an integral component of strategic alliances; limitingglobal exposure; and targeting terrorist networks and funding. His hedgingstrategy involves hardening key policies and strategies to limit risks ofterrorism, increasing ground and space-based surveillance of terroristresources, and preparing to mitigate the effects of terrorism to limit negativeeffects. Kress andassociates reiterate the first component of Lessers core strategy in offeringtheir proactive approach to dealing with terrorism; specifically, addressinggenuine political injustice and resolving supposed injustices.Chalk contends that a state response to terrorism must be limited,well-defined and controlled to avoid compromising the political and civiltraditions that are central to the liberal democratic way of life. He suggeststhat any liberal democratic response to terrorism has to rest on oneoverriding maxim: a commitment to uphold and maintain constitutional principlesof law and order. Conclusion The long history ofterrorism, dating as far back as ancient Greece, suggests that this phenomenon maynever be eliminated as a tactic by those people or groups without sufficient formallegal power to achieve their goals. However, this does not imply that terrorismcannot be engaged proactively and reactively. Logically, it seems that thefirst step should be to agree on a universally-accepted definition forterrorism because, without a consensus on the meaning of the term, effectivelyaddressing its causes and its effects may be difficult at best and impossibleat worst. With a consensusdefinition in hand, the comprehensive strategy for dealing with terrorismproposed by Lesser reduction in systemic causes, deterrence, superterrorismrisk reduction, and retaliation would appear to offer the most balanced,effective approach. Todays leaders should realise that offensive and defensivemilitary action, so typical of traditional warfare, is quite ineffective as asole method for dealing with modern forms of terrorism as demonstrated byfailures experienced by Israel in dealing with the Palestinian terroristproblem and the greater-than-expected difficulties experienced by the UnitedStates, the United Kingdom, and others in ridding the world of radical Islamicterrorists. These efforts may not only fail to ultimately deal effectively withpreventing terrorist activities, but may also produce more terrorists who are offendedby military actions. Alternatively, a holistic approach one which includesproactive prevention and reactive punishment measures such as the approachadvocated by Lesser should be employed. In any solution to theglobal problem of terrorism, the cautionary advice offered by Peter Chalkshould be considered; that is, political and civil liberties should not besacrificed in responding to the terrorist threat. For the very way of life thegovernments of free societies are trying to protect in their attempts to combatterrorism could be compromised by actions that are not limited, well-definedand controlled. Interestingly, this thought was eloquently proffered more thantwo centuries ago by American inventor, journalist, printer, andstatesman Benjamin Franklin in warning that [t]hose who would give upessential liberty to purchase a little temporary safety, deserve neitherliberty nor safety. An Appraisal Of Police Reforms In Kenya Criminology Essay Police Services form part of the executive arm of the Government. Before the promulgation of the Constitution 2010, on 27th August 2010 they were referred to as Police Forces and were under the Ministry of State for Provincial Administration and Internal Security. The two Police Forces were the Kenya Police and the Administration Police Forces established under the repealed Police Act Chapter 84 and Administration Police Act Chapter 85 respectively. Together with other three sister departments in the Ministry, that is the NACADAA, the Government Press and the Provincial Administration, the five key departments are all answerable to one Accounting Officer under the Ministry. The Commissioner of Police has been the in charge of the Kenya Police Force while the Commandant of Administration Police, who before 27th August, 2010 operated under delegated authority  [1]  , has been in charge of the Administration Police Force. More often than not the Police have found themselves in crossroads with members of public and Civil Society Organizations. This has led to them being viewed as the key violators of Human Rights  [2]  . They have earned a title violators rather than protectors and keepers of Human Rights. The Alston Reports  [3]  on Judicial killings laid blame on Police on deaths and disappearance of youth without anybody accounting for them. Several shootings of innocent individuals have been associated with the Police guns. The duty imposed on Police of Protection of life and property has been reduced to perception that they are to eradicate life and property of innocent people. The experts on commission for enquiry and thinkers of reforms came up with recommendations in their report after the 2007-2008 Post Election Violence which associated most loss of life to the excessive use of force by police amongst other vices and omissions. Waki Report  [4]  indicate that the security forces were powerless against the violence. Often, when we think of police reforms, the people concerned many a times tend to either forget or neglect the primary reason and function of the police service right from the initial stage it was formed to where they focus it to be, which is of great importance and should always be taken seriously. Peaceful co-existence and calmness in the society is the recipe for experiencing and enjoyment of freedom and human rights. With breach of this, society is bound to be in a chaotic state, confusion and fear. This is why police work always comes in handy if professionally applied backed with strong laws and reliable independent judicial systems. The society creates laws and puts in place the justice system to deal with law breakers; police on the other hand has a responsibility to enforce these laws within the society for the purpose of sustaining peace and calmness. When a society enjoys relative peace and order, it signifies that people obey the laws laid down with offenders being subjected to justice promptly. Strict justice systems and societies law obedience always ease the work of police. You can institute police reform, you can reorganize service delivery but you cannot alter the fundamental principles of policing and police operations. Reformers and reform agendas must be cognizant of another reality that police officers and police services are delivering something that some people in the society are opposed to. No one wants to be a victim of crime. No one wants the law, criminal or regulatory, enforced on them.  [5]   Police reform or review will not make this disappear and no matter how you package or tidy up service delivery or the players, there will always be displeasure with the police. So we mostly find that the performance of any organization depends on the principles on which it is founded and the tempered actions of its officers. Violations of the founding principle of an organization lead to straying away hence corruption, inefficiency and partisan personnel who can easily be misused by influential who have personal interest of enriching themselves. It is because of this, that the police have found themselves being misused by politicians as they serve as agents of political executives rather than as an instrument of a democratic state. This leaves a weak police Service heavily reliant of its masters who politicize and destabilize the police hence vices. The police force had been marked with a reputation of applying the law selectively against opponents, whether political or personal, at the behest of person of influence. Impunity has reigned supreme and hence reforms appearing to be a distant reality. Security is a basic human right as it is underlined by Article 3 of the Universal Declaration of Human Rights. As a member of the family of nations, Kenya subscribes to this Declaration. As a country, we regard security as a matter of national priority.  [6]  Security of persons as a basic human right is also one of the most significant factors contributing to the quality of communities worldwide. Security provides an enabling environment for citizens to live and work in, and it stimulates social, economic and political development.  [7]   Kenyas transition, and prospects of development, hinge to a great extent on the countrys ability to guarantee security within her borders. This is a goal that the current Government is committed to attain. It is also a good that many Kenyans are longing for.  [8]   It is against this background that there have been attempts by the Kenyan Government to institute police reforms. Though the Government had initiated the Police Reforms since 2004 when the NARC Government first came to power, on platforms of Reforms, these reforms were largely operational and administrative as they did not address the structural policy and legislative reforms that were fundamental in transforming the Police.  [9]   Consequently, the Government appointed the National Task Force on Police Reforms on the 8th May, 2009, led by The Hon. Justice (Rtd) Philip Ransley in Kenya Gazette Notice No.4790.1  [0]   The Task Force was mandated with the following Terms of References:-1  [1]   Examine the existing policy, institutional, legislative, administrative, and operational structures, systems and strategies and recommend comprehensive reforms taking cognizance of the recommendations contained in agenda 4; Kriegler, Waki and other Police related Reports so as to enhance police efficiency, effectiveness and institutionalize professionalism and accountability.(Special focus to be given to recommendations on Police Service Commission; Independent Police Oversight Authority; Policing Policy; and National Security Policy); Examine the existing competence, skills knowledge and attitudes of the Police at all levels and make recommendations aimed at enhancing shared core values, policing excellence and benchmarking against international best practices. Review the human resource management and development policies with a view to examine current standards and practices in recruitment, deployment, training, career progression, exit, post-exit management and recommend implementation of changes that enhance morale, meritocracy and professionalism; Review the tooling, logistical and technological capacity and recommend changes necessary to sustain modern security management, disaster management, conflicts and early warning/rapid response systems and joint operational preparedness strategy; Review the state of preparedness of the police to combat insecurity and other forms of emerging security challenges occasioned by national and international threats such as terrorism, piracy, organized gangs, drug/human trafficking, industrial espionage, cyber crime, money laundering, and economics crimes; Review and recommend strategies to harmonize and fast-track partnership between the community and security agencies in policing; Design a continuous monitoring and evaluation mechanisms to track police reform gains and consistency of policing needs; Recommend appropriate institutional arrangement to oversee the implementation of comprehensive police reforms; Prepare a draft Police Reforms Bill to embrace the comprehensive Police reform agenda; Make any other appropriate recommendations that add value to police reforms; and Develop a prioritized implementation matrix clearly categorizing the immediate, medium, and long- term police reforms and the attendant budgetary requirements. Within two and half months to submit to the President its findings and recommendations. The task Force submitted its report on October 2009 having made various recommendations summarized under four headings:-Professionalism, accountability, operational and administrative reforms and institutional policy and legislative reforms On 8th January,2010, the Government established the Police Reforms Implementation Committee charged with the responsibility of coordinating, supervising, providing, technical guidance, facilitation as well as mobilizing resources, communicating, monitoring and evaluation of reforms in the police.1  [2]   The promulgation of the Constitution of Kenya, 2010 on 27th August, 2010 marked a milestone on the issue of the Police Reforms in Kenya.To crown it all, Article 243 to 2471  [3]  constitutionally provided a departure from the previous regime organizations of the police matters. 1.1. Objectives of the Study The study intends to appraise police reforms in Kenya and recommend the best approach to reforms, hence contribute to the process of reforming the police in Kenya to be more effective and accountable in their service. The research will also act as an informative tool and strengthen the knowledge of the readers, researchers, and any other interested parties. Specific objectives of the study were: To identify indicators of police reforms; To identify appropriate analysis and measurement tools to measurement the level of police reforms in Kenya; To gauge the level of police reforms and to benchmark with that of other countries; To recommend measures for the realization of police reforms in Kenya. 1.2 Problem Statement The following points summarize problem statement concerning police reform in Kenya that this research seeks to address: Not much has been done in terms of realistically appraising police reforms in Kenya. There is lack of continuous expert evaluations along the way. In certain cases, internal evaluations that are deficit of technical analysis are carried out, the reliability of the findings may be questionable; The police still have outdated colonial cultures and brutality with deep rooted corruption rate which is a concern of the public, the Kenya Government and the international community; Lack of professionalism; ineffective supervision and poor managerial skills; inadequate and oversight accountability and oversight mechanisms in the police; Slow pace of enactment of necessary legislations to speed up the reform process; 1.3. Scope of the Research It was necessary to clearly define boundaries of the research to focus on the objectives of the study and to eliminate ambiguities. The focus of the research was to assess the successes, failures and challenges of police reforms by identifying reform indicators and gauging reform activities using them. The goal was to shed light into the realities of police reform efforts by highlighting achievements and by benchmarking with other exemplary strides in Africa and the world. This research, being an appraisal, meaning judging the nature/value of the reform process or making considered opinion on quality/extent/status, the research dwelt on aspects that closely correlated with reform evaluation. 1.4. Theoretical Framework There are various theories which justify reforms. These theories explain the relationship between the ways things are and how they ought to be, the realisms and the idealisms. The Natural Law vie propound true law as the right reason in agreement with nature.1  [4]  That law is universal, eternal and unchanging and that there is only one source of law and the enforcer of this eternal and unchanging law is God. That law is a rule whereby man is induced to act or restrained from acting. Principles common in all natural law theories are that1  [5]  there are absolute values against which the validity of law should be tested. That there exists an order which is rational and which can be known by man. That man can become aware of the universal, eternal and comprehensible values, if he observes nature and understands it correctly. And that from these values man may derive appropriate value-statements. That, that which is good is in accordance with nature and which is evil contrary to nature. That a law which lacks moral validity is wrong and unjust. Positivism refers to a system of philosophy based on things that can be seen or proved rather than ideas. The basic premise of positivism lies in the derivation of positum meaning that the law is something posited or laid down. The positivist law argues thus that true law is law enacted by the sovereign and backed by sanctions1  [6]  :- Law is a social fact; The idea of law being a command emanating from a sovereign power; The idea that law must embody a medium of sanctions; The separation of law from morals or ethical concerns; That society must be in habitual obedience of the law; Idealism refers to the practice of forming or pursuing or believing in ideas, even when this is not realistic. It is the belief that ideas are the only things that are real or about which we can know anything.1  [7]   The theoretical framework of this study is therefore to be based on the natural and positive school of thoughts which are related in that positivism arose to answer defects in the naturalists understanding of law1  [8]  . But more to the ideas of the two theories, the study is based on idealisms, what ought to be rather than what is. 1.5. Conceptual Framework There are a number of concepts that explain policing e.g. problem-oriented policing, evidence-based policing, community policing, predictive policing and intelligence-led policing. This research proposes the framework of predictive policing to analyze police reforms in Kenya. Predictive policing is defined as any policing strategy or tactic that develops and uses information and advanced analysis to inform forward thinking crime prevention1  [9]  . Predictive policing concept involves data mining, geospatial prediction, statistical probability and social network analysis. Since this research involves much of data mining and intense use of statistical methods, the concept suits this research. Predictive policing approach originated from a number of sources including intelligence and business analytics2  [0]  . This approach was adopted because the criminal justice system in Kenya currently has inadequate tools and research to the development of evidence-based practices. This concept is embraced as the police services continue developing intelligence-led policing To be able to use this approach, the research proposes a boiling pot model with a pot of reform factors on a three stone hearth acting as pillars firing the reforms. The pillars support the police organization and energize management, administration and the entire police structures. These pillars are capacity legal environment, personnel, budget compensation, personnel, training equipment. The results of the boiling pot are reduced crime rate, observance of human rights, police-public cooperation, public acceptance of the police service, political independence of the police, incorruptibility and reachable police service with authority. Figure 1 The boiling pot model of police reform Source ¼Ã… ¡Author The boiling pot model was proposed in this research as an innovative way of explaining police reforms in the context of predictive policing since a lot has to be in place to facilitate boiling. The reform process needs support and should any one pillar crumble, effects are seen in the results which are squarely dependent on input from the pillars. Again, if the boiling heat goes down, expected results are delayed, half-realized or not achieved at all. Figure 1 illustrates police reforms boiling pot model. 1.6. Limitations of the Study There were obstacles that possibly limited the validity of results of this study to some extent. Limited time and hurdles of data collection ranging from resources to field visits were cumbersome. Questionnaire questions are possible sources of error; so great care in constructing them is essential if valid information is to be gained from the survey2  [1]  . Some of the interviewees declined to answer questions or were busy or lacked interest hence could give unreliable information. This research addressed this limitation, according to guidelines by Barbara and Robert (1980), A Practice Guide to Behavioral Research, pp. 20, using interview techniques like probes and other means of avoiding socially desirable response-statements and other undesirable interviewer/respondent interactions. Availability of data on police reforms is highly limited especially in Africa2  [2]  . Available police data from the Kenya Police and Administration Police is ad hoc and not systematically collected and cannot be very reliable in appraising the successes and failures of police reforms in Kenya. Chapter 2. Literature Review Berkeley2  [3]  notes: reform is such a strong word (which) is often misapplied in regard to police service delivery. Too often it becomes the term for what should be called organization or structure review. Reform is defined as a change for the better or improvement by removal of faults2  [4]  ; it means to fine-tune and restructure without radical changes2  [5]  . Police reforms therefore mean restructuring the police services with the aim of improving them; changing them for the better and fine-tuning the services. In respect to security sector reforms, SSR, police reform is defined as the transformation of a security system, including all the actors, their roles, actions and responsibility to manage and operate the system in a manner that is consistent with democratic norms and sound principles of good governance2  [6]  . 2.1. Police Reforms in Africa Policing in Africa is still inadequately documented and has been shaped by colonial rule that was greatly concerned with protecting interests of the colonial power compared to safeguarding safety and security needs of the people2  [7]  . After colonial rule mostly during the 1960s, development of more personal, impulsive and arbitrary neo-patrimonial rule played a role in shaping the police. Incumbent regimes utilized colonially inherited repressive capacity of the police to defend regime interests2  [8]  . Since many countries in Africa have faced internal civil war, brutality and destruction, the police became perpetrators, targets and casualties. The 2008 violence in Kenya saw role of Kenyan police forces with large scale brutality and extra-judicial killings in a large scale2  [9]  . Dynamics of police reform in Africa is understood within the context of policing environment for example in conflict-ridden areas, rural area policing, role of politics in reform process among others. In conflict areas, general policing is always seen as irrelevant or as part of the problem since more of military approaches are adopted. In such cases, new armed units which act as roving agents of repression and control3  [0]  are created to defend the interest of the power of the day. There are proofs of intimate connection between police and politics in Africa3  [1]  . Police reform is regarded a political endeavor and political interests are fundamental to the reform process. Police reforms envisaged in Africa involve changes in structure, function and legitimacy. Structurally police change from centralized to decentralized form; functionally the police change from emphasizing defense of regime to protection of citizens, and regarding legitimacy the change is from regime-based to people-driven legitimacy3  [2]  . Police Reforms in South Africa and the United States of America It is important to do comparative analysis of police reforms in Kenya with that in the USA and South Africa as benchmarks. The two countries are chosen as pinnacles of police reforms with South Africa giving a realistic African example. 2.2.1. Police Reform in South Africa Police reform in South Africa is understood within the unique political context. Apartheid system had racial status as its main feature and security institutions were organized in a similar way  [38]  39. South African Police and the judiciary were dominated by white officers at the senior level. Apartheid was known for brutality of security forces and widespread violation of human rights. During 1960 1990, about 78,000 people were detained without trial by the police because of political activism against apartheid  [40]  . Seventy-three executions in detention by police were recorded during that period of formal apartheid. In recent years, security forces were responsible for high levels of torture, extra-judicial executions and disappearance of pro-democracy activists. The coercion of unpopular racist laws created a deep crisis of legitimacy in the pre-reform criminal justice system in South Africa. In the late 1980s, the state of apartheid was in serious crisis forcing the police, army and bureaucracy to invent strategies, one being National Security Management System (NSMS) to defeat the liberation movements. The police and military suppressed protests during the State of Emergency declared in 1985 and there were mass arrests, trials, persecution, and murder. Police reform was shaped by negotiated political settlement after apartheid, that agreed to retain all employees of the apartheid government, police officers included. The settlement also created a Government of National Unity and Truth and Reconciliation Commission which dealt with some police abuses in apartheid. As negotiations were going on, the police were already involved in framing new arrangements for the management of public order and security of elections under the auspices of the National Peace Accord multi-party experience that gave the police a preview of the style required by democratic government. The police reform process was given highest priority in the first period of transition and state institutions relevant to effective combat of crime were put in place  [41]  . Mandela government had a challenge to build trust between state agencies, including the police, and the citizens. The police was given legitimacy of being associated with the new regime and was attached to repression of apartheid. Police-community relationship was to be built to allow the basic functionality of the police institution  [42]  . The initial steps to police reform in South Africa were shaped by clear strategic decision taken by the government with strong emphasis on accountability and oversight. In the second term of the democratically elected government, after political control and legitimacy has been achieved, the government started to emphasize the role of police in fight against crime. With many unresolved issues in initial stage of police reform, the government gave great importance to several strategic priorities and policies leading to great ideas in paper but inadequate capacity to implement policies in the police institution. Though South African experience of police reform is cited as a model for other African states, the process was laborious and often agonizing for members of the police organization  [43]  . 2.2.2. Police Reform in the United States of America Initial efforts of reform were through establishment of external commissions that outlined reforms and left the burden of implementation to the police. Important changes in policing, in respect to civil rights and constitutional law, were realized through a number of court decisions  [44]  3. Court decisions between 1961 and 1966, especially Mapp versus Ohio and Miranda versus Arizona, were highly influential and thus began to set national policing standards  [45]  3  [4]  . During the 1970s, special commissions were used to create changes in police and other law enforcement agencies. Permanent external oversight agencies were used to improve police accountability. The agencies focused on individual improvements3  [5]  and left out broader organizational issues that could result to long-term reform initiatives. Enactment of Violent Crime Control and Law Enforcement Act in 1994 allowed for suits against law enforcement agencies with regard to abuses resulting into many departments signing memorandum of understandings to reform3  [6]  . The United States Department of Justice conducted investigation on abuse patterns in police and brought legal action to force changes. Less-than-lethal weapons like chemical sprays were introduced as alternatives to deadly force3  [7]  . Police reform encouraged police officers to try to deescalate situations with verbal warnings and persuasion and consider use of force continuum3  [8]  . 2.3. Key Lessons from South Africa and USA The following are clear from the two experiences3  [9]  : Substantial resistance to police reform efforts is highly expected from economic elite who gained from the old system and institutions which control public security apparatus; Sectors that feel insecure would champion for citizen-oriented policing; There is possibility of politicians taking selfish advantage of the reform process and thus violating the spirit of police reform; The government in place may form parallel police units that undermine development and legitimacy of the reform process or even favor particular police units compared to the others; In attempts to demilitarize the police, attention should be focused on composition, mission, doctrine and hierarchical separation of the police from military command; Participation of previously neglected groups in policing helps to ensure that policing is effectively representative of and responsive to the society. International actors can provide assistance with issues of composition and doctrine, as well as advice. To achieve effective reforms, there is need to strengthen and equip crim

Capital Punishment and the Bible      Ã‚  Ã‚  Ã‚   Capital punishment has always been an arguable issue and for good reason. The Old Testament clearly calls for the death penalty on many occasions, whereas; many of the teachings of Jesus and others in the New testament readily denounce it.   Therefore, both advocates ands opponents of capital punishment have Biblical references to support their beliefs.      Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Opponents use the creation story to show that all are created in God's image.   Genesis 1:27a states that â€Å"God created man in his image.†1   God, thus, has the power to give and take away life as he chooses.   All men are to preserve life to the best of their ability.   M. Margaret Falls says that we cannot treat people as mere instruments to personal survival, success or fulfillment.2      Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Advocates will also utilize Genesis   1:27 to prove that because man is created in God's image, man must preserve as many lives as possible,   Therefore, the death of one, who has murdered many, will spare the useless and countless deaths of others.   God's command to preserve life seems much more important here than the preservation of criminals.      Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Capital punishment is never used legitimately in the New Testament.
